VACATION RENTAL AGREEMENT This rental agreement is made between Laura Parker (“Proprietor”), and (“Renter”) for the renting of 3395 Dry Creek Road in Napa (“Premises”). Unless otherwise limited below, this rental agreement covers and includes the Cottage and parking areas. Renter shall contact Proprietor at 619-379-3456 with any questions. 1. The Rent due under this agreement is $400/per night per 30-day period. Renter is free to occupy the Premises during the Term but no discount will be offered for vacating the Premises sooner than the expiration date. 2. Your arrival will be on as per VRBO Confirmed check in date, no earlier than 3:00 pm and your departure will be as per VRBO Confirmed Check out date no later than 11:00 am. 3. Renter must submit 50% of the Rental Amount within 5 days after Proprietor confirms the reservation, with the balance of the rental amount 30 days prior to arrival. 4. The property is furnished and includes everything. 5. Security Deposit: Renter shall provide a security deposit of no less than $1,000.00 security deposit no later than 30 days prior to arrival. This security deposit covers any damages or loss to the property occurring during the time specified on this contract. No later than 14 days after Renter vacates the property, the security deposit will be returned, less any deduction or damage. Proprietor will itemize any damage to the Premises. 6. Renter shall also provide a non-refundable prepaid cleaning fee of $400.00 together with the first payment, which shall be in addition to any security deposit collected by Proprietor. 7. Cancellation policy and Liquidated Damages: The parties agree that but for this liquidated damages provision, it is impracticable or extremely difficult to fix the actual damage that would occur in certain specific circumstances, limited to Renter’s cancellation of this Agreement. All money received for a confirmed reservation is non-refundable, but the security deposit and cleaning fee will be returned if Renter cancels prior to arrival. There are no exceptions. 8. Children: Due to dangerous conditions on the Premises, the property is NOT appropriate for children. Therefore, Except as otherwise provided by law, Renter is strongly discouraged from bringing children on the premises, unless arrangements have been made between Proprietor and Renter prior to the date of first occupancy. 9. Indemnification and Hold Harmless: Renter agrees to indemnify and hold harmless Proprietor, its officers, directors, agents, and employees, from and against any and all claims, demands, obligations, causes of action and lawsuits and all damages, liabilities, fines, judgments, costs (including settlement costs), and expenses associated therewith (including the payment of reasonable attorney fees and disbursements), arising out of: (1) the failure of Renter, its employees or agents, to comply with the terms and conditions of this Agreement; (2) the intentional, criminal and/or negligent acts or omissions of Renter, its employees, agents, or subcontractors towards each other or third parties; or (3) the services performed or actions taken by Renter, its employees or agents, in connection with this Agreement, including the operation and management of any event or activity incidental thereto. 10. Insurance: We encourage all renters to purchase travel and renters insurance. 11. Miscellaneous Provisions a. This property is zoned agricultural watershed. Because of the neighboring vineyards, guests acknowledge that agricultural, industrial, and commercial equipment may be used in the neighboring vineyards from time to time, sometimes 24 hours a day. This may cause disruptive noise or stir up dust. Renter acknowledges that their quiet enjoyment of the premises may be affected by agricultural activity at surrounding parcels. This is normal to the area and out of owner’s control. b. Access: Renter shall allow Proprietor access to the property for purposes of repair and inspection. Proprietor shall exercise this right of access in a reasonable manner. c. Force Majeure: Any delay or failure of either party to perform its obligations hereunder shall be excused to the extent that it is caused by an event or occurrence beyond its reasonable control such as, by way of example and not by way of limitation, acts of God, actions by governmental authority (whether valid or invalid), fires, floods, windstorms, explosions, riots, natural disasters, wars, sabotage or labor problems; provided the party claiming force majeure promptly notifies the other party of the event of force majeure, the anticipated duration of the event of force majeure, and the steps being taken to remedy the failure. Force majeure does not include the illness, infirmity, or scheduling change of any guest. d. Governing Law; Severability: This Agreement is to be governed by and construed according to the laws of the State of California, excluding any such laws which direct the application of laws of any other jurisdiction. If any term of this Agreement is invalid or unenforceable under any statute, regulation, ordinance, executive order or other rule of law, such term shall be deemed reformed or deleted, but only to the extent necessary to comply with such statute, regulation, ordinance, order or rule, and the remaining provisions of this Agreement shall remain in full force and effect. e. Attorney’s Fees: Should the parties commence any litigation concerning this Agreement, or the rights and duties of either in relation thereto, the party prevailing in such litigation shall be entitled to such other relief as may be granted, including reasonable attorney’s fees and costs. People other than those in the disclosed above may not stay overnight in the property. Any other person in the property is the sole responsibility of Renter. 2. The Premises is Proprietor’s private property; Proprietor is not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. Proprietor is not responsible for any guest’s loss of personal belongings or valuables. By accepting this reservation, it is agreed that Renter and all guests are expressly assuming the risk of any harm arising from their use of Premises or others whom they invite to use the premise. 3. Keep the property and all furnishings in good order. Only use appliances for their intended uses. 4. Pets: Except for service animals or as otherwise required by law, neither Renter nor Renter’s guests may bring or keep pets on the premises unless approved by Owner. 5. No Smoking: Neither Renter nor any guest of Renter is to smoke on the Premises. 6. Parking: Parking is limited to 7 vehicle(s). Vehicles are to be parked in designated parking areas only. Parking on the road is not permitted. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner. 7. Housekeeping: There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. 8. Water and Septic: The Premises is on a well and septic systems. The mineral content in the water is high. The well water may have an odor. The septic system is very effective; however, it will clog up if improper material is flushed. DO NOT FLUSH anything other than toilet paper. No feminine products should be flushed at anytime. If it is found that anything other than biological matter and toilet paper have been flushed and clog the septic system, you could be charged for septic system repairs. This is a beautiful property with a quaint, simple cottage. Its a perfect place to relax and enjoy the sights and sounds of nature.
